How Does Spousal Support Work in Oregon?

What Types of Spousal Support Do Oregon Courts Recognize?
Oregon recognizes three different categories of spousal support awards, and each one is based on a unique purpose.
The first type is called Maintenance Support, and its goal is to enable the two divorcing spouses to live separately at a standard of living comparable to what those individuals enjoyed during marriage, to the extent possible. This type can be awarded for a limited timeline or indefinitely.
The second type is called Transitional Support, and its goal is to enable one of the divorcing spouses to adjust to re-entering the job market and becoming self-sufficient. This type is typically awarded in one lump sum or for a limited timeline.
The third type is called Compensatory Support, and its goal is to compensate one of the divorcing spouses who has made a significant contribution, financial or otherwise, to the education, training, and/or career of the other spouse. This type is typically only awarded in one lump sum or for a limited timeline.
How do Oregon Courts Decide Spousal Support?
Judges are given wide leeway in considering the type and amount of spousal support to award in individual divorce cases. Their key consideration is what is “just and equitable” in a given case. In other words, spousal support is not need-based, but instead is based on what seems reasonable and fair.
Each of the three categories of spousal support involves a specific list of factors judges use in making decisions about spousal award. Some of these factors overlap between categories, and they include:·

- The ages of the divorcing spouses
- The individual earning capacities of each divorcing spouse
- The standard of living each spouse is accustomed to
